NY Judge overturns local law letting ATVs on public road

ALBANY, N.Y. (AP) A state judge has overturned a local law that would have allowed all-terrain vehicles on a public road after the Adirondack Council sued.
Adirondack Council Executive Director William Janeway said the nonprofit group filed the lawsuit against the Oneida County town of Forestport to protect adjacent Adirondack Forest Preserve land as well as local residents. The lawsuit claimed the town's law violated state law regarding the use of highways by ATVs, and failed to assess the potential for damage to the environment.
Adirondack Council spokesman John Sheehan said state Supreme Court Justice Samuel Hester in Utica ruled from the bench on Feb. 25.
Janeway said the council is trying to discourage unlawful expansion of ATV riding in the Adirondacks. The group won a similar lawsuit against Lewis County in 2007
